1. Scope and Subject Matter of the Contract

These Terms of Use govern the relationship between Gravitasaudience GmbH (hereinafter "Provider") and all users of the gravitasaudience.com platform. The platform provides tools for digital communication, target group analysis and the development of modern media strategies. By registering or using the content, you agree to these terms.

The Provider provides the services in their current version. There is no entitlement to specific functions or availability unless expressly agreed in writing.

2. User Obligations and Code of Conduct

You undertake to use the platform only within the framework of applicable laws. In particular, it is prohibited to:

• Collect, store or process data of third parties without their consent
• Distribute malware, spam or misleading content
• Use the analysis results for unlawful purposes such as fraud or discrimination
• Disclose access data to unauthorized third parties

In the event of violations, the Provider reserves the right to block access to the platform without prior notice and to take legal action.

3. Limitation of Liability

The Provider is fully liable for damages resulting from intent or gross negligence, as well as for injury to life, body or health. For slight negligence, the Provider is liable only in the event of a breach of essential contractual obligations (cardinal obligations), limited to the typical, foreseeable damage.

The analyses and strategy recommendations provided are based on algorithmic evaluations. No guarantee is given for the accuracy, completeness or economic usability of the results. Each user is independently responsible for reviewing and implementing the content.

Liability for lost profits, data loss or indirect damages is excluded to the extent permitted by law.

4. Rights to Content and Intellectual Property

All content provided on the platform, in particular texts, graphics, logos and software components, is protected by copyright. Use is permitted only within the scope of the contractual purposes. Reproduction, distribution or making publicly accessible beyond personal use requires the prior written consent of the Provider.

Content uploaded by the user (e.g., campaign data or target group segments) remains their property. The Provider receives the right to process and store this data for the purpose of providing the service.

5. Data Protection and Data Processing

The processing of personal data is carried out in accordance with our privacy policy, which is available at policy.html. The Provider processes data only to the necessary extent and in compliance with the GDPR.

The user is obliged to comply with data protection regulations when using the analysis tools. In particular, all data entered into the platform must have been lawfully collected.

6. Term, Termination and Changes

Use of the platform begins upon registration and runs for an indefinite period. Both parties may terminate use at any time without stating reasons. For paid services, the statutory notice periods apply.

The Provider reserves the right to change these terms with reasonable notice. Changes will be communicated by email or via a notice on the platform. If the user does not object within four weeks of notification, the new terms are deemed accepted.

7. Final Provisions

The laws of the Republic of Austria apply, excluding the UN Convention on Contracts for the International Sale of Goods. The place of performance and exclusive place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the Provider in Vienna.

Should any provision of these terms be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose.
